In re M.D.

M.D. was required to register as a sex offender for a juvenile adjudication arising out of an incident that occurred when he was a teenager.

Juvenile Law Center and American Civil Liberties Union of Michigan filed an amicus brief in the Michigan Supreme Court in support of M.D., arguing that sex offender registration is unconstitutional for youth under the United States and Michigan Constitutions. Our brief emphasized that sex offender registration has devastating consequences for youth and fails to advance the penological goal of rehabilitation. We further argued that youth registration does not protect, but rather undermines, public safety. 

The Michigan Supreme Court remanded the case to the Michigan Court of Appeals and directed the Court of Appeals to consider whether 2021 amendments to Michigan’s Sex Offenders Registration Act preclude M.D. from having to register as a sex offender.
