Moore v. Gwathney

Juvenile Law Center joined attorney Rhonda Brownstein, Alabama based civil rights attorney Henry F. Sherrod III, and attorney Joshua Toll of law firm King & Spalding in filing a lawsuit in the U.S. District Court for the Middle District of Alabama on behalf of Cayce Moore and Jimmy Click. Mr. Moore and Mr. Click were both initially sentenced to life without parole for crimes committed when they were youth and were later resentenced to life with the possibility of parole following the U.S. Supreme Court decisions in Miller v. Alabama and Montgomery v. Louisiana. Despite this, as alleged in our lawsuit, Mr. Moore and Mr. Click are doomed to die in prison due to the policies, procedures, and practices of the Alabama Parole Board, which do not afford those serving life with parole sentences for youthful offenses a meaningful opportunity to obtain release based upon demonstrated maturity and rehabilitation as required by the Eighth and Fourteenth Amendments.
